Liberals might not want to start celebrating their temporary immigration victory just yet. President Donald Trump is about to throw something unpleasant into the punchbowl.
In a decision that left American conservatives shaking their heads in disgust, a three-judge panel of the 9th Circuit Court of Appeals upheld a stay on Trump’s executive order to suspend immigration from seven countries known to export terrorism.
But The Donald has three words for liberals who think they’ve won: “I’ll be back.”

Trump is not backing down from this fight and has indicated that a re-worked order may be announced — and soon.
“We’ll be doing something very rapidly having to do with additional security for our country. You’ll be seeing that sometime next week,” he said at a news conference Friday, according to Newsmax.
“I’d like to surprise you.”

Also Friday, White House press secretary Sean Spicer said the administration is keeping its options open.
“On background: to clarify, we could take the TRO (temporary restraining order) to Supreme Court. We are reviewing all our options in the court system and confident we will prevail on the merits of the case. Additionally, we are actively pursuing other executive orders that will keep our country safe from terrorism,” Spicer said, according to Bloomberg.
Trump has several courses of action available, according to The Washington Post. He can simply sign a new order, which is fast but clearly not a permanent fix, as the entire judicial mess will likely start over. He can appeal to the full 9th Circuit Court of Appeals in hopes that it will override the three-judge panel that issued Thursday’s unanimous ruling.
He can take the restraining order case to the Supreme Court, as Spicer said. Or he can keep fighting in the lower courts.

Prominent lawyer Alan Dershowitz thinks Trump has a good shot in the Supreme Court. In an interview with MSNBC’s Chris Matthews on Thursday, he said “Look, this is not a solid decision. This is a decision that looks like it’s based more on policy than on constitutionality. There are many, many flaws.”
What the president is not likely to do is back down. He promised to keep America safe, and he is demonstrating an absolute commitment to do so.
Legal scholars from the liberal Dershowitz to the conservative (and not very Trump-friendly) National Review agree on the real point: President Trump’ s immigration order is within the bounds of his executive authority granted under The Immigration and Nationality Act of 1952. It’s the law, and the judiciary exists to uphold the law.
